专精特新企业培育指南：申请和认定的关键步骤

一、专新企业的定义和分类

根据《国家高新技术企业认定管理办法》（以下简称《办法》），专新企业的定义是：

在国家重点支持的高新技术领域内，从事研究开发、技术转化和产业化的科技型企业，具有自主知识产权、核心技术和高增长潜力，符合国家高新技术企业认定条件的企业。

专新企业的分类是根据《国家高新技术领域》（以下简称《领域》）进行的，目前《领域》包括以下10个大类，每个大类下又细分为若干小类：

电子信息技术

生物与新医药技术

航空航天技术

新材料技术

高技术服务

新能源与节能技术

资源与环境技术

先进制造与自动化技术

化学与化工技术

其他领域

申请专新企业的企业必须属于以上10个大类中的至少一个，且其主营业务必须与所属领域相符。

二、专新企业的申请条件和材料

根据《办法》，专新企业的申请条件包括以下四个方面：

注册地和注册时间：申请企业必须在中国境内注册，且注册时间在申请年度的前两年内（即2024年申请的企业，注册时间应在2022年1月1日至2023年12月31日之间）。

知识产权和核心技术：申请企业必须拥有自主知识产权或者授权使用的核心技术，且该技术属于《领域》范围内，能够支撑企业的主营业务和产品（服务）开发。知识产权和核心技术的形式包括专利、商标、著作权、集成电路布图设计、植物新品种、技术秘密等。

研发人员和投入：申请企业必须具备一定的研发能力和水平，且在申请年度的前一年（即2023年）的研发人员数量和研发费用投入比例达到一定标准。具体而言，研发人员数量应占企业全体员工的10%以上，且不低于10人；研发费用投入比例应占企业销售收入的5%以上，且不低于300万元。

销售收入和增长率：申请企业必须具备一定的市场竞争力和发展潜力，且在申请年度的前一年（即2023年）的销售收入和增长率达到一定标准。具体而言，销售收入应不低于500万元，且其中高新技术产品（服务）的销售收入占比不低于60%；销售收入的增长率应不低于15%，且连续两年保持正增长。

专新企业的申请材料主要包括以下几类：

企业基本信息：包括企业名称、注册地、注册时间、注册资本、法定代表人、联系方式、组织机构代码、统一社会信用代码等。

企业财务信息：包括企业财务报表、税务报表、审计报告等，反映企业的资产、负债、收入、支出、利润等情况。

企业研发信息：包括企业研发机构、研发人员、研发项目、研发费用、研发成果等，反映企业的研发能力和水平。

企业知识产权和核心技术信息：包括企业拥有或者授权使用的知识产权和核心技术的证明材料，如专利证书、商标注册证、著作权登记证、技术转让合同、技术许可合同等，反映企业的技术创新和优势。

企业高新技术产品（服务）信息：包括企业主要的高新技术产品（服务）的名称、特点、功能、市场、竞争对手等，反映企业的市场竞争力和发展潜力。

三、专新企业的认定流程和时限

专新企业的认定流程主要包括以下几个步骤：

在线申报：申请企业通过国家高新技术企业管理系统（以下简称系统）进行在线申报，填写相关信息，上传相关材料，提交申请表。

初审：由申请企业所在地的省级科技主管部门（以下简称省科技部门）对申请企业的申报信息和材料进行初步审核，确认申请企业是否符合申请条件，是否属于《领域》范围内，是否提交了完整的申报材料等。初审结果分为通过、补正和不通过三种，通过的进入下一步，补正的需要在规定时间内补充完善申报信息和材料，不通过的需要重新申报。

专家评审：由国家高新技术企业认定管理工作领导小组（以下简称领导小组）组织专家对通过初审的申请企业进行现场或者视频评审，评审内容主要包括申请企业的研发能力、知识产权和核心技术、高新技术产品（服务）等。专家评审结果分为通过、补正和不通过三种，通过的进入下一步，补正的需要在规定时间内补充完善申报信息和材料，不通过的需要重新申报。

公示：由省科技部门将通过专家评审的申请企业的基本信息在系统和省科技部门网站上进行公示，公示期为10个工作日。公示期间，任何单位和个人可以通过系统或者书面形式对公示企业提出异议，省科技部门应当及时处理异议，并将处理结果反馈给异议提出者和公示企业。

认定：由领导小组根据省科技部门的初审意见、专家评审意见和公示意见，对申请企业进行综合评定，确定认定名单，并在系统和领导小组网站上公布。认定企业将获得由领导小组颁发的《国家高新技术企业证书》和《国家高新技术企业名称牌》。

备案：认定企业应当在收到《国家高新技术企业证书》后10个工作日内，向省科技部门提交备案材料，包括《国家高新技术企业备案表》、《国家高新技术企业证书》复印件、法定代表人身份证复印件等。省科技部门应当在收到备案材料后5个工作日内，完成备案登记，并将备案信息反馈给领导小组。

专新企业的认定时限为每年一次，具体时间安排如下：

1月1日至3月31日：申请企业进行在线申报，省科技部门进行初审。

4月1日至6月30日：领导小组组织专家进行评审，省科技部门进行公示。

7月1日至9月30日：领导小组进行综合评定，确定认定名单，颁发证书和名称牌。

10月1日至12月31日：认定企业进行备案登记，领导小组进行监督管理。
